BIOGRAPHY OF GEORGE E. MACKINNON

George Edward MacKinnon was born in St. Paul, Minnesota on April 22, 1906, the son of James Alexander Wiley and Cora Blanche (Asselstine) MacKinnon. He attended the University of Colorado, and was graduated with honors from the University of Minnesota Law School in 1929, having also won All-American rating as center on the Minnesota football teams of 1925-1927, and the Western Conference Medal of 1929.

Following graduation he entered private practice in Minneapolis and acted as assistant general counsel to Investor's Syndicate that later became Investors Diversified Services. Elected from the 29th District to the Minnesota House of Representatives in 1934, 1936, 1938, and 1940, he served on the Rules Committee and as chairman of the House Judiciary Committee. He authored and led the fight for the 1939 Minnesota State Reorganization Act, and drafted the state Civil Service Law of 1939 and the state Old Age Assistance Law of 1936.

In 1942 MacKinnon volunteered for duty with the United States Navy, spent four years with the Atlantic Fleet Air Force, earned a citation for meritorious services, and was discharged a commander.

Upon his return in 1946 he was elected from Minnesota's Third District to the United States House of Representatives and served on the Education and Labor Committee. As a congressman MacKinnon worked with Richard M. Nixon on drafting the Taft-Hartley Act and on the investigation of Alger Hiss. MacKinnon was defeated for reelection in 1948. From 1949-1953 he was engaged in private practice in Minneapolis, was active during the period 1949-1952 in the campaigns of Harold E. Stassen, and served in 1952 as research director for Nixon in his first vice presidential campaign.

On April 1, 1953, MacKinnon was appointed United States District Attorney for Minnesota. He investigated and prosecuted one of the most famous labor racketeering cases in the country--United States v. Gerald Connelly--two years before the McClellan Committee began its investigations.

In 1958 he resigned his post as United States District Attorney to accept the Republican nomination for governor of Minnesota, a contest he lost to Orville Freeman. During 1960 MacKinnon focused on labor racketeering investigations that specifically involved James Hoffa as a special assistant to United States Attorney General William P. Rogers. From 1961 to 1969 he was general counsel and vice president of Investor's Mutual Funds in Minneapolis.

In 1969 President Nixon appointed MacKinnon a judge of the United States Court of Appeals for the District of Columbia circuit. While on the D.C. circuit bench MacKinnon also served as presiding judge for the United States Foreign Intelligence Surveillance Court of Review, as a member of the U.S. Sentencing Commission, and as presiding judge of the Division for the Purpose of Appointing Independent Counsels.

MacKinnon married Elizabeth Valentine Davis, born on August 5, 1915 in Palmer, Massachusetts, on August 20, 1938. The MacKinnons had three children and lived in Long Lake, Minnesota, 1948-1969, and Potomac, Maryland, 1969-1995. MacKinnon died May 1, 1995.

SCOPE AND CONTENTS OF THE PAPERS

The papers of George E. MacKinnon span the years 1927-1995 with the majority concentrated after 1947 when MacKinnon served one term as a representative in the 80th Congress. The strengths of the collection focus on domestic policy issues immediately following the second world war, the political campaigns of Harold Stassen and Richard Nixon, organized crime investigations of Minnesota labor and liquor rackets during the 1950s, and the inner deliberations of a federal appellate court during the latter twentieth century. The papers include correspondence and memoranda, bills, committee files, investigative materials, legal case files and opinions, press releases, reports, speeches, printed items, clippings and additional materials related to the political, professional, and judicial aspects of MacKinnon's life. The collection is divided into three series: Political and Professional Subject Files, Court of Appeals, and Personal Papers.

The Political and Professional Subject Files are further divided into sections representing each major aspect of MacKinnon's life and include materials from his roles as a legislator, district attorney, political campaigner, and federal judge. The files that document his legislative term center on domestic policy issues and contain substantial information on communism, taxation of cooperatives, foreign aid, housing, immigration, Minnesota issues and concerns, Palestinian independence, postal service, railroads, Republican Party affairs, the armed services, and the work of the House Education and Labor Committee. Files originating from his work as district attorney for the state of Minnesota contain investigatory and subject materials. The investigatory materials focus on Minnesota labor and liquor rackets, particularly the activities of the Teamsters Union and Isadore Blumenfeld (Kid Cann). Political files providing information about Harold Stassen's 1948 and 1952 presidential campaigns and Richard Nixon's 1952 vice presidential campaign are included with the files from MacKinnon's legislative term. Additional political files concentrate on MacKinnon's unsuccessful gubernatorial campaign against Orville Freeman in 1958 and Nixon's 1968 presidential campaign. Files representing MacKinnon's term on the Court of Appeals for the District of Columbia constitute the bulk of the collection. These files provide rich and extensive documentation of latter twentieth century challenges to constitutional, criminal, and regulatory laws and reveal the judicial decision-making process behind the interpretation of those challenges. Files for every case brought before MacKinnon, including many Watergate-related appeals, are contained within this section. Additional files document MacKinnon's roles on the division of the court that appointed independent prosecutors and the commission that formulated federal sentencing guidelines. Information regarding suits contesting the constitutionality of the Independent Counsel Act and the sentencing guidelines are also included.

The personal papers contain materials related to MacKinnon's naval service during World War Two (1942-1946) and also include his personal correspondence spanning the years 1940-1995. Topics discussed throughout the personal correspondence complement information contained in the subject and court files regarding state and national politics, the Republican Party, criminal investigations, court cases, University of Minnesota 1924-1927 football teams, and family history. POLITICAL AND PROFESSIONAL SUBJECT FILES

The subject files are arranged in five sections that document MacKinnon's activities, interests, and concerns during the times he served as a representative from Minnesota's 3rd district in the 80th Congress, as the U.S. District Attorney for Minnesota and Special Assistant to the U.S. Attorney General, as gubernatorial candidate against Orville Freeman, as an advisor to Nixon's 1968 presidential campaign, and as a Court of Appeals Judge. Many of the topics from one period are carried over to others.

U.S. Representative, 80th Congress, 1933-1953 (bulk 1946-1952)

This set of subject files primarily represents MacKinnon's legislative concerns while he was a member of the U.S. House of Representatives during the 80th Congress (1947-1948). Many files are related to his seat on the Education and Labor Committee that drafted the Taft-Hartley Act and to MacKinnon's interest in economic policies. In addition this section includes materials related to the 1948 and 1952 presidential campaigns of Harold Stassen and the 1952 vice presidential campaign of Richard M. Nixon. MacKinnon served as one of Stassen's key supporters in both the 1948 and 1952 campaigns and then served as director of Nixon's research team after Stassen lost the 1952 Republican nomination to Dwight Eisenhower. Much of the correspondence and reports included within these campaign files contain advance strategy and information regarding public opinion and the activities of other candidates. Files from Stassen's 1952 campaign include detail regarding MacKinnon's investigation of petitions to place Eisenhower's name on the Minnesota primary ballot. Additional political files are related to MacKinnon's campaigns for the Minnesota legislature.
The file contents include memoranda, constituent correspondence, notes, speeches, reports, informational pamphlets, press releases, news clippings, and magazine articles and reprints. Government publications ranging from bills and circulars to reports and administrative rules and regulations are also included. House bills introduced by MacKinnon regarding emergency housing, Social Security benefits, internal revenue and unemployment taxation, veterans bond payments, and psychopathic personalities are also included. U.S. District Attorney for Minnesota, 1927-1969 (bulk 1953-1958)

This set of subject files primarily represents MacKinnon's investigative and prosecutorial concerns while he was U.S. District Attorney for the State of Minnesota. Senator Edward J. Thye recommended MacKinnon for the post to replace Phillip Neville as he left the office for private practice. The majority of the investigative materials pertain to cases involving either labor or liquor rackets. These investigations particularly focused on the activities of Isadore Blumenfeld (Kid Cann) and the Teamsters Union. While district attorney MacKinnon successfully prosecuted the first labor case under the Taft-Hartley Act against Archer Daniels Midland, Gerald Connelly, and Sidney Brennan. MacKinnon resigned from the U.S. District Attorney's office in June of 1958 in order to campaign for the seat of Minnesota's governor.
A few files also pertain to MacKinnon's 1960 position as a special assistant to the U.S. attorney general. MacKinnon particularly focused on labor rackets in this position and started the Test Fleet investigation that eventually led to James Hoffa's perjury conviction.
Additional information regarding some of the high profile cases that MacKinnon investigated as U.S. District Attorney are included within the subject files kept during his 1958 Gubernatorial Campaign and his tenure on the Court of Appeal. 1968 Presidential Campaign, 1964-1969

During the 1968 presidential campaign MacKinnon was general counsel and vice president for Investors Diversified Services. He also served as a member of Nixon's advisory group. This set of files contains outgoing and incoming correspondence, materials distributed by the Nixon for President Committee, a proposed crime policy program, press releases, and Nixon speech texts. MacKinnon's numerous letters to Nixon gave advice on the organization and execution of his campaign. There are also many letters addressed to Rose Mary Woods, Nixon's secretary, who routed MacKinnon's suggestions and attached materials to the appropriate people. Subject matter includes MacKinnon's evaluations of the Minnesota, Oregon, Wisconsin, New Hampshire, and Texas campaigns, analyses of grass roots opinion, general political advice, suggestions for strategies against Hubert H. This series contains the personal subject files MacKinnon kept while an appellate judge on the bench of the District of Columbia. Many of the files demonstrate his long-standing interest in organized crime and labor rackets. There are files on Tommy Banks, Kid Cann, and Jimmy Hoffa as well as files on a number of other notorious gangland figures. There are also files documenting his continued interest in the Republican Party and the careers of Warren Burger, Orville Freeman, Hubert Humphrey, Richard Nixon, and Harold Stassen. Files particularly relevant to MacKinnon's position on the circuit bench include information regarding his appointment, installation, and 25-year anniversary; correspondence with his former law clerks; and an outline for a proposed autobiography. This section also includes numerous materials pertaining to football including a Hall of Fame nomination that details MacKinnon's college record.

COURT OF APPEALS

MacKinnon was 62 years old when President Nixon nominated him on April 23, 1969 to the vacancy left by Charles Fahy on the Court of Appeals in the District of Columbia Circuit. The Senate confirmed his appointment on May 8, 1969 and he was sworn in on June 16, 1969. MacKinnon took senior status on May 20, 1983 at age 77 after 14 years of full active service and continued to serve on the court for another 13 years until his death in May of 1995. During that time he served as presiding judge of the U.S. Foreign Intelligence Surveillance Court of Review (1979-1982), went to Milan as a delegate to the 7th United Nations Congress on the Prevention of Crime and the Treatment of Offenders (1985), was designated by the Chief Justice as presiding judge of the special division of the Court of Appeals for the appointment of independent counsels (1985-1992), and was appointed by President Reagan as a member of the U.S. Sentencing Commission (1985-1991).

The Court of Appeals series comprise the largest portion of MacKinnon's papers. The most significant of this portion are the case files that constitute almost ninety percent of this series and that represent every appeal brought before MacKinnon. These files provide a complete record of MacKinnon's opinions and also provide a rare inside look at the overall decision-making process of the District of Columbia Court of Appeals during the period 1969-1984. MacKinnon's caseload decreased when he was appointed to work on independent counsel and sentencing guideline matters in 1985.

Cases included by these files cover a wide range of civil and criminal matters of procedural and constitutional law. In addition to these types of cases MacKinnon also sat on numerous cases involving federal regulatory law as well as cases involving federal agencies or branches of the federal government. Most notable among these federal cases were the Alaska pipeline case (Wilderness Society v. Morton) and the many Watergate-related cases.

Other outstanding features of this series are the files that document MacKinnon's tenure on the division that appointed special prosecutors at the request of the U.S. Attorney General to investigate governmental abuses of power and the commission files that document MacKinnon's role in the development and implementation of federal sentencing guidelines. Also included within this portion are general topical files pertaining to MacKinnon's chambers and materials from judicial conferences. No materials from MacKinnon's service as presiding judge of the U.S. Foreign Intelligence Surveillance Court of Review (1979-1982) are evident in the collection.

Case Files, 1969-1995

The case files are arranged by principal docket number and include bench memoranda; MacKinnon's notes taken during oral arguments; summaries of bench conferences; research notes and background material; voting sheets and memoranda; disposition memoranda; correspondence from litigants, their counsel, and the public; and news clippings. The files also include MacKinnon's opinions in their first handwritten draft, typed redraft, galley, final proof, and printed slip form as well as the opinions drafted and circulated by other judges. The opinions are often accompanied by correspondence between MacKinnon and other judges.
These materials offer rich documentation of the reasoning behind varying opinions and demonstrate how the judges negotiated their differences. In addition, the files can reveal as much about MacKinnon as they can about the other members of the Court. Some of the judges with whom MacKinnon sat later went on to become justices of the U. S. Supreme Court including Robert Bork, Ruth Bader Ginsburg, and Anthony Scalia. Other judges reflected by the case files include Harry T. Edwards, Oliver Gasch, Harold Leventhal, Abner Mikva, Roger Robb, Aubrey E. Robinson, Spottswood W. Robinson, Kenneth Starr, Edward A. Tamm, Patricia Wald, and J. Skelly Wright.
Some of the case files also contain correspondence between MacKinnon, former law clerks, law professors, and others regarding issued opinions. For the majority of the cases, trial briefs are not included. Additional docket numbers for consolidated cases in which more than one appeal was heard at the same time are listed in parenthesis following the principal name of the case. Eighteen civil actions appearing at the end of the docketed set had originally been set aside by MacKinnon for a book project.
Indexes to the cases are divided into two sets: one set for appeals in which MacKinnon wrote an opinion; the second set for cases in which MacKinnon did not write an opinion but served as a member of the judicial panel. Both sets consist of an individual 3x5 card for each case heard by MacKinnon. The cards are filed by the name of the appellant and include the title of the case, the docket number(s), the date of oral argument, the judges assigned to the panel that heard the case, the judges that wrote opinions, the date the decision was delivered, a citation if the opinion was published, and later actions if the case was further appealed to the Supreme Court. Some cards also include brief summaries of judgments and their impact on other cases.
The first opinion MacKinnon authored concerned the consolidated appeal of two women whose applications to proceed as paupers in divorce proceedings were denied by the district court (Case No. 22266, Harris v. Harris). Later opinions included numerous criminal, first amendment, personal injury, gender discrimination, anti-trust, labor, environmental, regulatory, civil rights, and Watergate-related cases. Brief comments concerning major cases are sometimes included in MacKinnon's personal correspondence.
High profile criminal cases in which MacKinnon issued opinions included United States v. Decoster (72-1283) and United States v. Ross (79-1624). The Decoster case, deliberated by the court three times over a period of six years, debated the standards used to prove a defendant's claim about the inadequacy of counsel. The case also tested whether the burden of that proof rested upon the defendant or the prosecution. MacKinnon dissented in the first and second appeals and wrote a minority opinion in the third appeal. Ross's appeal challenged the legality of a search of a paper bag contained in a car trunk. The majority opinion upheld the exclusionary rule while MacKinnon dissented upon the basis of what constituted a reasonable expectation of privacy. The U.S. Supreme Court later reversed the majority and sustained MacKinnon's dissent.
The environmental case that probably gained the most widespread attention was the Alaska pipeline case of Wilderness Society v. Morton (72-1796, 72-1797, 72-1798). Against objections brought by the Wilderness Society and other environmental groups that disturbances to wildlife habitation had not been properly evaluated, MacKinnon ruled that the Department of Interior's environmental impact statement was adequate to permit construction of the pipeline. Numerous other environmental cases concerned the Clean Air Act and included the cases of Ethyl Corp. v. EPA (73-2205, 73-2268, 73-2269, 73-2270, 74-1021), Amoco Oil Co. v. EPA (74-1231), Ford Motor Co. v. EPA (78-1791, 78-1794, 78-1799), Motor and Equipment Manufacturer's Association v. EPA (78-1896, 78-1901, 78-1931, 78-1943, 78-1944), and Lead Industries Association v. EPA (78-2201, 78-2220).
Notable first amendment cases included O'Hair v. Andrus (79-2170) brought by Madelyn O'Hair against the Department of Interior for taxpayer costs associated with a mass held by Pope John Paul II on the National Mall; Grace v. Burger (80-2044) that tested the prohibition against demonstrations and leafletting on the grounds of the United States Supreme Courthouse; Murray v. Buchanan (83-1301) that challenged the use of public funds to pay the salaries of congressional chaplains; and the libel cases brought by William Tavoulareas against the Washington Post (82-1654, 83-1604, 83-1688).
Despite the personal relationship between MacKinnon and Nixon, MacKinnon did not recuse himself from any appeals stemming from the Watergate scandal. Those cases included the following: United States v. Liddy (73-1020, 73-2074, 73-2080, 73-2081, 73-2082, 73-2083, 73-1562, 73-1564, 73-565); Nixon v. Sirica (73-1962); the cases of Bernard L. Barker, Virgilio R. Gonzales, Eugenio R. Martinez, and Frank A. Sturgis, consolidated as United States v. Barker (73-2185, 73-2186, 73-2187, 73-2188); United States v.
