BIOGRAPHY OF ROSALIE WAHL

Rosalie Wahl was born as Sara Rosalie Erwin on August 27, 1924 in Gordon, Kansas, the third daughter of four children born to Claude William and Gertrude (Patterson) Erwin. Growing up in the Depression era, Wahl experienced tremendous personal hardship. Her mother died when Wahl was three years old and she, with her sisters and brother, moved to live with her maternal grandparents on a farm near Birch Creek, Kansas. Four years later, Wahl's grandfather and brother were killed by a train after she opened a gate that led from the farm to the creek across a set of railroad tracks. She spent the remainder of her childhood on that same farm in Birch Creek and was raised by her grandmother with help from her mother's sister, Sara Patterson.

In 1942 Wahl entered the University of Kansas intending to pursue a journalism degree. The following summer she returned to Birch Creek to teach. Her fiancé, an air force serviceman, died the next winter in a training accident. Wahl describes herself at this time as torn between choosing a life of poetry and mysticism or following a path of social and political activism.1 Determined to pursue a field where she could help people, Wahl went back to the University where she edited the campus newspaper and became involved with the campus YWCA where she helped form a women's interracial residential cooperative. During this time Wahl became a Quaker. In 1946 she graduated with a degree in sociology and though she had planned to go to California to work with migrants she instead married Roswell Wahl, a family friend and mechanical engineer.

Wahl's first child was born in 1947 and, in 1949, the family moved to Circle Pines, Minnesota to participate in a newly-formed cooperative community. Three more children were born while the family lived in Circle Pines and then, in 1955, the family moved to a former dairy farm in Lake Elmo where Rosalie Wahl has lived since.

In 1962 at the age of 38 and "tired of sitting outside doors waiting for the men inside to make the decisions,"2 Wahl entered the William Mitchell School of Law. Her fifth and last child was born in 1964. In 1967 she graduated with her law degree and passed the state bar examination. Immediately thereafter she began working for the state as an assistant public defender. In 1972, the same year she and her husband divorced, Wahl taught criminal law at the University of Minnesota. The following year she accepted a professorship at William Mitchell where she directed the clinical legal education program. This was both an experimental and controversial program as students, under supervision and in cooperation with the state's public defender office, were representing indigent defendants in criminal court proceedings.

In 1977 Governor Rudy Perpich appointed Wahl to the Supreme Court to replace Harry H. MacLaughlin. Wahl's appointment was significant as she was the first woman jurist to sit on the state's highest court. While on the Supreme Court, Wahl served as its liaison to the Court's Study Commission on the Mentally Disabled and also chaired its task forces on gender fairness and racial bias. These committees gathered information through public hearings, questionnaires, and court statistical data that was used to evaluate the judicial system and its proceedings. The findings and recommendations made by these committees were used to implement changes within the judicial system through training sessions, procedural rulings, and legislation.

Wahl sustained her earlier interest in clinical training and professional development throughout her judicial career by participating in the Section of Legal Education and Admissions to the Bar of the American Bar Association. She chaired that section in 1987-1988 and proposed the formation of a study group headed by Robert MacCrate to examine the continuum between legal education and practice. Wahl's own role in this study group was to chair a subcommittee that drafted a statement on fundamental lawyering skills and professional values.

Elected to the court in 1978 and successively reelected in 1984 and 1990, Wahl retired at the mandatory retirement age of 70 in 1994. When she retired, women held four of the seven Supreme Court seats.

SCOPE AND CONTENTS OF THE COLLECTION

The collection contains papers Wahl kept in her judicial chambers as well as personal papers she collected prior to and during her judicial career. Included are biographical information; speeches and writings; files regarding her Supreme Court appointment, elections, opinions, and committee work; subject files; materials related to her interest in legal education; and files detailing her connection with civic associations during the late 1950s and early 1960s.

The focus of the collection is on Wahl's role as liaison to the Supreme Court's Study Commission on the Mentally Disabled, as chair of the Court's Task Force on Gender Fairness and later of its Implementation Committee, and as chair of the Task Force on Racial Bias. Included are committee memoranda, correspondence, minutes, research data, reports, training materials, procedural rules, legislative proposals, news clippings, and background information. Other materials regarding Wahl's judicial term include files related to some of the opinions she wrote and files concerning the candidacy of other judicial nominees and applicants.

Wahl's concern about legal representation for the poor and her interest in professional skills training are also well documented. Subject files provide information regarding the legal aid activities of the state bar association as well as the state public defender system.

A separate series details Wahl's activities in the American Bar Association's Section of Legal Education and Admissions to the Bar.

The collection also includes an extensive set of speech files that begin with the remarks she made at the Minnesota Woman's Meeting in St. Cloud on June 3, 1977 just after her appointment to the Supreme Court was announced. Other less extensive materials document Wahl's earlier work with both the Friends of the Library and the Citizens Committee on Education in Washington County.

Biographical Information, 1960s-1995

These files contain an assortment of materials providing details about Wahl's life and achievements. Included are resumes, news clippings, magazine excerpts, television news spots, a sample of her fingerprints, photographs, award certificates, membership certificates, diplomas, and a set of tributes written at the time she retired by her court and academic colleagues for publication in the William Mitchell Law Review. The biographical information also contains two oral history interviews: the first conducted by Norma J. Wikler (sociologist and consultant to the Supreme Court's Task Force on Gender Fairness) and Laura Kadwell (Wahl's law clerk, 1981-1982) on March 25 and 27, 1990; the second conducted by Laura Cooper (University of Minnesota law professor) on August 17, 1994. The interviews include discussion about her childhood and college years in Kansas, the move to Minnesota to engage in a cooperative living experiment, her entry into law school, her work with the state public defenders office and as a professor at the William Mitchell College of Law, her appointment to the Supreme Court, her first election, the Court's task forces on gender fairness and racial bias, and her judicial opinions in a few selected cases. Photographs included within this series contain both formal and candid portraits of Wahl as well as formal group portraits of the Court justices.

Civic Associations, 1958-1962

This series contains materials pertaining to Wahl's involvement in two voluntary associations before she began to study law. Included are files pertaining to a subcommittee that surveyed parents and made recommendations about the required length of the school year to the Citizens Committee on Education in Washington County. Also included are materials regarding a movement by the Friends of the Library to expand library services in Washington County from a mobile unit supported by the Stillwater Public Library to a consolidated system governed by a county board. The files contain committee minutes, reports, memoranda, correspondence, Wahl's notes, newsletters, and news clippings.

Speeches and Writings, undated and 1975-1998

The speeches and writings are arranged chronologically by speaking engagement. Each speech is identified by title, sponsoring party, audience, event, place, and date. If Wahl gave no title to her text, the file is simply identified as "Remarks" or by the type of presentation such as "Commencement address." In some instances the audience, event, or place also may not be identified.
Wahl's speaking engagements included keynote addresses, conference sessions, panel presentations and responses, training seminars, investitures, introductions, tributes, eulogies, commencements, and award ceremonies. Her audiences included judges, lawyers, bar associations, educational institutions, women's organizations, peace officers, correctional workers, mental health professionals, religious congregations, school children, and other special interest groups. The topics on which she spoke covered a wide area and often drew from her own experiences. Generally her themes covered such issues as social justice, constitutional law, legal training and professional development, women's roles, leadership, feminism, parenting, family law, and health. Other speeches address specific events or activities such as her own judicial appointment or the findings and recommendations of the various court and bar association committees on which she served.
Though not reflected elsewhere in the collection, Wahl was a Quaker and some of her speeches were given to Unitarian, Congregational, or Friends gatherings. During these presentations Wahl spoke very candidly about her own faith and world-view and these remarks provide a most intimate glimpse of her inner persona.
The majority of the files contain Wahl's handwritten texts. Others appear in typescript form. The files may also include correspondence, program announcements, pamphlets, photographs, and press clippings related to the speaking engagements. Quite frequently, Wahl excerpted portions from one speech for another presentation by framing her opening remarks to the particular audience. Examples of these speeches are grouped together under a topical heading such as "gender fairness speaking file."
Wahl often quoted poetry in her speeches and though she was especially fond of Emily Dickinson, she sometimes used her own poems. Two files preceding the chronological arrangement include typed selections of her poetry as well as an audio tape of Wahl reading her own poetry.
Some of Wahl's presentations were later published in journals or newsletters. Published versions of these presentations are included within the relevant speech files. These publications include a lecture delivered to the Hamline University Law School on March 9, 1978 titled "Equal Justice Under Law: Dream or Reality"; an address to the 1980 Friends General Conference published in Friends Journal as the article "Here Am I! Send Me"; an address given to the Women's Law Caucus at William Mitchell on April 10, 1986 and published under the title "Some Reflections on Women and the Judiciary;" an address titled "More Prelude than Token" made at the October 1991 conference of the National Association of Women Judges; and a speech given at a conference of the Legal Writing Institute in Seattle on July 20, 1996.

Includes excerpts from Wahl's calendar, an envelope from Governor Perpich's office containing ballots cast by Perpich and his "kitchen cabinet" advisors, and Wahl's notes from meetings with the seated justices prior to her investiture. Also included is a copy of a letter Wahl wrote to Governor Perpich on March 28, 1977, before she had ever been introduced to him, voicing her concern about Perpich's proposal to close the state hospitals in Anoka and Hastings. After her appointment, Wahl discussed this letter in a meeting with Chief Justice Sheran that resulted in the Chief Justice assigning her as the liaison to the Supreme Court's Study Commission on the Mentally Disabled.
